Social Learning Theory: Properly Applied or Just an Excuse?

Here in Anytown, the outraged cries or the joyous exclamations can be heard from citizen.  The local Department of Job and Family Services have implemented a policy stating that any parent that has been arrested for domestic abuse, child abuse, or anything to do with drugs or alcohol will have their children removed from their home.  Upon removal the children will become a ward of the state and be placed within a variety of foster homes throughout the community.  Parents who have lost their children will have to complete at least one of the following treatments, and in some cases all of them, prior to the return of their children: alcohol and/or drug treatment, counseling, family therapy, mental health treatment, anger management, life skill classes, and/or parenting classes.  When implementing this policy the Department of Job and Family Services called into reference the Social Learning Theory as a means to support their actions.  Today, the issues of benefits vs. the negatives, ethical/moral issues, and the impact on everyone involved will be addressed.  Then the meaning of Social Learning Theory and whether or not the theory was indeed applied correctly will be explored.  The discussion will end with my personal opinion on this issue.
There are a few benefits to this new policy.  It reduces the chances of children being mistreated.  It also lessens the exposure, that each child in those conditions is subject to, that can have a negative impact on what they learn.  Some children will be exposed to a more positive environment and

improved living conditions.  Although the negatives that come along with this can counter the benefits.  The negatives include, an overcrowding of foster homes, some children being taught more negative behaviors from other children than what they would have learned within their own homes, and education can be at risk because the children may be more concerned with what is going on in their personal life and less worried about school work.  Another issue that should be taken into account is that the court system may begin to become clogged not only with the parents who are trying to gain custody of their children back but by allegations against foster parents.
This policy infringes on the rights of parents.  Their children are being ripped from their homes without an individual cause.  The charges of spouse abuse, “child abuse, and drug/alcohol problems are the leading reasons that children get removed from the home to begin with,” (Weldon, 2001, Foster Care: A Psychological War).  Although if the parents have already had documentation of these issues then one would infer that they have already paid for their injustices.  Either the state at the time of the charges the state deemed the home safe or the children have already been removed and allowed to return.  It must be asked, after a man or woman pays for their crimes is it ethical or moral to make them pay a second time?  Is that not double jeopardy without a second trial?  Ethnically what this policy is doing is not exactly right.  Some of these parents have committed these offenses prior to

even having children, and now the well-being of their child is at risk due to something that had happened in their past.  With a policy like this every parent here in Anytown has to be aware of their action and live in fear that a decision that they have made and deemed acceptable can ultimately cost them their children, even for a small portion of time.
Everyone in the community is going to be affected by this policy.  The thing that will affect every citizen the most is the increase in taxes that will have to be implemented to support all the foster homes.  As a result of the increase of taxes, the economy will start to suffer.  Less money in the pockets of the citizens means less money to pay bills and to acquire the items that are essential for everyday life.  Without people spending money, factories and stores will begin to layoff and even shut their doors, decreasing our job availability here in Anytown.  Parents will also be at risk of losing their jobs, as it is, because of trying to complete the programs required to get their children back.  This will make meeting the Department of Jobs and Children’s required standards take more time.  As stated by Charlotte Weldon (2001), children are at risk of suffering from psychological problems such as separation anxiety, behavioral issues, and depression.  The family unit will have to readjust upon the return of the children, adding unwarranted stress to everyone in the community.  There is a large chance of the development of psychological issues from having to witness the problems in the home, and then add the stress of being moved from home to home numerous times.  It can be foreseen that the damages that this policy can cause that it may actually cause an increase in crime among Anytown’s youth.

The basis of this policy is the Social Learning theory, defined as “the view that people learn to be aggressive by observing others acting aggressively to achieve some goal or being rewarded for violent acts” (Siegel, 2007, p.109).  It can be seen how the Department of Jobs and Children thought that by implementing this policy that they were doing the community a favor, based on the definition of Social Learning theory.  In a home where charges of domestic or child abuse have been a problem in the past, one would infer that the children of these parents would observe violent behavior.  Although, something that hasn’t been taken in account is the aggressive behavior these children see with their peers and on television.  Removing a child from their home does not extinguish these observable factors.  Then it must be discussed that children of parents with drug and alcohol problems may never be subjected to aggressive behavior, in fact these children may never even see their parents using these things.  The definition also states that the aggressive behavior being learned through observation is deemed good to the child because the behavior is being rewarded.  Parents that have been arrested or at the very least charged for the behaviors that the policy specifies as unacceptable, so they did not get rewarded, but instead punished.

In my personal opinion, the Department of Jobs and Children misinterpreted the Social Learning theory.  This theory not only covers just bad behaviors learned at home but things that are learned through watching friends, television, video games, or any form of behavior observation where aggressive behavior is rewarded.  The man that came up with the Social Learning theory was Albert Bandura.  Recounted by Schacter, Gilbert, Wegner (2009), Bandura came up with an experiment called the “Bobo Doll Studies,” where he had two groups of children observe adults acting aggressively with this doll.  One group saw the adults get reprimanded for being aggressive with the doll and the other group observed that the adults didn’t get in any trouble for such behaviors.  The children that witnessed the reprimanding of the adults acted less aggressively with the doll but the children that seen no punishment handed out for the behavior mimicked what they seen the adults doing to the doll.  These children were not ever exposed to aggressive behavior prior to this study yet they still acted aggressively toward the Bobo doll.  The adults they were observing weren’t even their parents, which shows that learned aggressive behaviors can be learned outside the home.
I believe that they failed to take into account all the other negative things that not only these parents and children with have to endure, but the negative impact on the community as a whole.  I think that this policy is not only unethical but goes against this nation’s Constitution.  I believe that the Department of Jobs and Children had only good intentions when implementing this policy but had they weighed the negatives against the few positives, they would have seen that this policy isn’t any way a good idea.  There are some positives that can come from this policy, such as, removing children that are exposed to truly dangerous home conditions, but that isn’t what the Social Learning theory is concerned with.

With exposure to the negatives, the few positives, and some repercussions, a person could easily come to the conclusion that this policy isn’t in the best interest of Anytown.  With a clear understanding of the Social Learning theory, it can be said that the Department of Jobs and Children misinterpreted the theory.  It is fair to say that the policy needs to be reconsidered and that the Social Learning theory shouldn’t be used as the main argument for the policy.  Whether you are one of the people saying the hoorays or part of the group that was crying out in anger, faced with the problems this policy can make, I think we can all agree that this policy needs to be reevaluated.

This is the time of the year when a child needs to have the emotional, mental, and financial support of both parents. No matter what age a child is if at all possible the relationship between their mother and father needs to be a healthy one. If there is a separation between the mother and father a structure for where the child will reside and how the visitation will be arrange is vital to the child having a healthy life.

Sometimes parents will separate and immediately or shortly after the separation either the mother or father who doesn’t have custody is to pay the other person a specific amount of money for having the child reside with them.

This is where the problem begins. Depending on the relationship of the adults the child may find themselves being sent back and forth which is emotionally, mentally, and physically draining. The transition of moving back and forth will not only affect how the child lives, but their education may also become a major concern. The effect of the separation and/or divorce may cause the child’s grades to be effected that the child may need tutoring in order to survive what is happening on the home front.

The court if it is involved may require a parenting plan be prepared to determine who the child will reside with, when, and other issues, such as child support. In order to survive the custodial parent may need the child support to pay his/her bills. The money is supposed to be designated for the child, but sometimes the financial demands require that the child support be used for the staples of the family needs.

If the non-custodial parent doesn’t pay the monthly child support then the family needs may not be met. If the non-payment becomes a problem, then the child may be affected by the actions of the non-custodial parent. Generally, the custodial parent attempts to work out an agreeable financial arrangement where everyone is a winner. If the non-custodial parent fails to make the agreed upon payment then the custodial parent will have no other choice but to have court support enforcement involved.

Court support enforcement is a division of the court and assists custodial parents in tracking down the parent who is not meeting their financial commitment. Of course the court support enforcement needs the support of the court in order to attach someone’s money e.g. paycheck, bank accounts, garnishment, and so forth.

If the parent who is delinquent of paying child support than access to the child, i.e. visitation may become an issue. This is a very complicated set of circumstances, but is generally dealt with by the court. The ruling by the court is if the non-custodial parent is incapable of paying the monthly child support then they should not be prevented from their visitation rights. This analysis is controversial as the majority of people who have family and friends in custodial and child support issues, believe the ideology should be if you don’t pay you won’t get the time with your child.

The custody of children legal structure has significantly become advanced over the past couple decades, credited by court support enforcement programs such as the Federal child support law which is titled, “Deadbeat Parents Punishment Act (DPPA) which was established in 1998 to punish parents. Parents who willfully fail to make child support payments by traveling to another state to avoid making child support payments are in violation of this Act. The law provides exactly how the punishment will be enforced. The punishment which is based on the amount of money owed to the custodial parent and how many years the money has been owed to the custodial parent may determine the length of sentence he/she will receive.

The punishment is serious and the non-custodial parent may be charged criminally, apprehended, arrested, convicted, and incarcerated for six months to two years. In addition to the incarceration the court may order the parent to pay back child support. The bottom line is if the parent doesn’t pay their child support payment, than the federal court may become involved. The DPPA provides guidelines and directions on how to process a complaint against a dead beat mom or dad.
Individual States have their own laws which in addition to the Federal law can punish the parent who has refused to pay their child support payments.

In the State of Washington there is a state-wide list of deadbeat parents on the Division of Child Support Enforcement (DCS). DCS takes many enforcement actions which in the end make dead beat parents lives difficult. One of the interesting and powerful tools is the custodial parent can request the suspension of the non-custodial’s drivers, professional and recreational licenses when they fail to meet their obligation.

When there is turmoil and animosity between parents sometimes allegations of criminal behavior such as child sexual assault allegations are brought forward generally by the custodial parent. The allegations of criminal behavior by either the mother or father of the child brings law enforcement into the picture as well as child protective services. Involving other agencies into an already dysfunctional situation can create further financial difficulties for both parties. Instead of paying the child support payment, the parent has to hire an attorney to have legal representation. The cost of divorces and child custody issues can cost thousands of dollars.

Law enforcement must begin the investigation with the ideology that there will be a historical aspect(s) to the criminal allegations. In some States in the courthouse the records are generally divided into several locations. The police records are housed within the records division of the police department. The civil, domestic, and administrative records are housed within the courthouse in different locations, generally in the county clerk’s office. A common problem when there are child sexual assault allegations and a custody or divorce matter has just concluded, is in progress, or soon to be an issue, law enforcement fails to check the records in other locations in the courthouse e.g. civil, domestic, and administrative records involving the custodial and non-custodial parents.

The civil, domestic, and administrative records can provide the law enforcement officer with a history of what has been happening in regards to the relationship between the parents. In some domestic relationships the allegations against one another are unbelievable. If the officer checks the records he will find the two parties accusing one another of being alcoholics, sexual addicts, having sexual affairs with prostitutes, endangering their children by being neglectful, violent, abusive, and so forth.

These true and false allegations need to be dealt with by the law enforcement officer who is responsible for investigating a child sexual assault case. Many law enforcement officers will not take the walk from their records division to the county clerk’s office where the civil, domestic, and administrative records may be kept.

Making an allegation that a parent spends time at the local bar and grill may have nothing to do with the child sexual assault allegations, but it may demonstrate a pattern by one of the parents to make allegations which have been proven to be false by the domestic court.

Using their child as a pawn to bring about disharmony and taking away someone’s freedom needs to be taken seriously. Law enforcement must do their due diligence and take that walk from their office to the next office. Records are stored because they have information and the information may be the difference between someone being criminally charged or not.

There are so many dead beat moms and dads in the United States with some States holding the non-custodial parent accountable for who they are. Although there is a Federal law that should make these people responsible and accountable it is unusual for the Federal government to criminally charge them. Imagine a prison full of dead beat moms and dads. If the government decided to pursue these people criminally there would not be enough space to house the serious violent criminals. There are other methods and techniques which are utilized by the different States which are effective. States work together to identify dead beat moms and dads and hold them accountable no matter what State they reside in.

Until such time the government decides that dead beat moms and dads are worth criminally pursuing these people will continue to have children which they choose not to financially support. Instead the State and Federal government are left to be responsible for children where their mother or father left and haven’t returned to take care of them emotionally, mentally, physically, and financially.

Today’s Investigative Special Report – December 24, 2012 “Dealing With Today’s Law Enforcement Specialized Investigations” “Coaching - In Child Sexual Abuse Allegations?”

An allegation of child sexual abuse has just been made against a man who lives in a middle class neighborhood. He is a well-known business man, is married, and has four children who range from 6-15 years of age. The man attends church at least three times a week, appears to be happily married, and the children in the neighborhood enjoy spending time at his home, sometimes spending the night.

One of his daughters, he has two, had a sleep over and everything seemed to go well, until one of the 12 year-old girls, upon returning home after the sleep over, told her mother that the father of her friend, the family man, church going, happily married, great man, touched her on her shoulders with his hand and this made her feel uncomfortable.

The mother reacted negatively to this news and began questioning her daughter. The first series of interviews between mother of the daughter lasted the entire day with breaks to go to the restroom, get something to eat and drink, and answer the telephone when someone was calling to talk to the young lady.

The next day the same scenario continued. In the meantime the mother of the alleged victim began making telephone calls to child advocate organizations, law enforcement, counselors, friends, family members, and anyone else who would listen to her. She was simply outraged that someone had touched her daughter in the shoulder area. At times her mind would race and she found herself visualizing what her daughter went through expanding the touching to a greater extent than what her daughter had disclosed.

Stop here and take a deep breath and try to slow things down. If it was your child and she came home and told you that the father of her daughter’s friend had touched her on any part of her body, what would your reaction to be? It would seem reasonable and logical that you would want to explore with your daughter exactly what happened. Probably you are not a forensic child sexual assault interview expert therefore there may be the possibility that some of your questioning may be leading and suggestive. This could be problematic for many reasons. These reasons are as follows:

1.      If your daughter has been sexually assaulted by the man then your questioning may provide your daughter with the opportunity to disclose “exactly” what happened. If this is the case you will need to stop the questioning, call the police and let a professional do any further questioning.
2.      If your daughter wasn’t sexually assaulted and you are not satisfied with her answer, because when you were young, the man who lived in your neighborhood had sexually assaulted you but you never told anyone. You think at this point that your daughter isn’t telling you everything because she is full of shame and guilt, even though if the allegations are true she may not want to disclose it. Just like it was when you were sexually assaulted.
3.      If you can’t determine if your daughter was or wasn’t sexually assaulted maybe waiting to talk to your husband would be the next positive and successful step you should take. Your daughter and your husband have an unbelievable relationship and if she was touched then maybe she might tell him “exactly” what happened.
4.      After your husband has met with your daughter and she told him the same thing you were told you may want to take it to the next step and have her interviewed by a professional. One of your thoughts should be is this event about your daughter or about the unresolved sexual assault you went through as a child. This question needs to be considered as sooner or later someone is going to ask what are you putting your daughter through. Moreover, why are you doing this?

Someone looking from the outside in may wonder if you have become a coach, coaching your daughter into disclosing a sexual assault that didn’t happen. If this is the case then the alleged trauma your daughter went through will be multiplied many times. So if this is true and you have become a coach, what type of coach have you become?

1.      Purposeful Coach: This is the type of coach which has a plan and coaching the child into saying things that are untrue benefits and assist them in accomplishing their goals.
2.      Intentional Coach: Coaches a child because they intend to cause as much trouble for the alleged perpetrator as possible. The intent has many motivational factors behind the allegation.
3.      Unintentional Coach: Coaches a child without thinking about what they are doing. Maybe seen as causing an allegation because of their negative feelings against the alleged perpetrators.
4.      Progressive Coach: Is similar to the “Intentional Coach” except this coach progressively begins coaching the child at an early age and eventually the child makes a false allegation.
5.      Silent Coaches: Is the most sinister coach as they intentionally coach the child in such a way that the child has no idea they are being manipulated. This type of coach can be seen in the child who has been sexually assaulted and the adults in their environment coach the child to not disclose the abuse.

The motive to coach is not always apparent and therefore needs to be examined and evaluated. Here are some motives to coach a child into saying that an individual had sexually assaulted them:

1.      Revenge
2.      Secondary Gain
3.      Retaliation
4.      To get the alleged perpetrator in trouble with law enforcement for something they didn’t do
5.      Manipulation
6.      Control
7.      Coaching creates results
8.      To accomplish specific goals
9.      Allows an investigation to take place against an alleged perpetrator knowing the allegation is false. This false allegation will cost the perpetrator financially, emotionally, effect relationships, and create unbelievable anxiety and stress.

Depending on the type of circumstances, the type of coach and the hidden motives for why an adult would coach a child to say that something sexually occurred when nothing happened is simply evil and unconscionable. Law enforcement in investigating any and all sexual assault allegations needs to be thorough and complete in determining if there has been any coaching of any kind when a possible disclosure occurred. The source to determine if coaching occurred will never come from the coach. However, if the alleged child victim is properly, competently, and intelligently interviewed then the fact finding process may uncover the truth.

The many questions which you may be asking is why would someone want a child to lie about something which didn’t occur have a multitude of answers. However, a law enforcement investigator has to have an Investigative Case Action Plan which considers that something is not right with a specific allegation. If the law enforcement officer has received the proper education and training, then they will be able to see the problem, why it occurred, and how it occurred. Once the coaching has been identified then the investigation needs to be focused on the coach and begin seeking criminal charges available to the law enforcement officer.
