Too often foster care parents accept children into their homes which child protective services have little to no information about who these children are. Further, there hasn’t been sufficient time to perform a complete and thorough background about the historical make-up of the children. A significant aspect of understanding, who these children are, comes from the information law enforcement and child protective services are able to obtain in a short period.
Therefore, for foster care parents who are willing to bring children into their home it is sometimes like rolling the dice.  The reasons are simple: One, children who have been sexually assaulted rarely tell others that they were assaulted; two, specifically disclosing the information that they were sexually assaulted to strangers (foster care parents) who have the power to make decisions about their well-being.  These children live in fear for at least the first 72 hours which provides them the time to adapt to their new environment and the people who live 
there.
The stories are numerous about a child who is sexually assaulted by her father, removed from her home, and placed in a foster care home where there are younger children. After a period of time one of the children comes forward and discloses to their foster care mother that the newly placed child sexually assaulted her and her siblings. Sometimes the sexual assaults involve the foster care parent’s biological children.
So what went wrong? Did the criminal justice system fail to assess and investigate the child they were required by law to place into foster care? Whose responsibility is it to make sure that the child they removed from the unsafe environment, did not, and then become a sexual predator as well.  Then given the opportunity may sexually assault the child’s peers or younger children in the foster care home.

Does the criminal justice system create more child monsters and child sexual assault victims? The answer seems complex, but if you examine and explore how the child protective service system works, the answers will become apparent. Caseworkers who identify a child sexual assault victim is required to remove the child from her home and place her in a safe home where she will be free from any sexual assaults. The problem which often occurs is the child needs to only fear themselves, as they don’t understand what a normal life style is and after a period of time they sexually assault their peers or children in the foster home.
This cyclical criminal justice foster care structure is perpetuated by a system where the checks and balances are fraught with holes, failures, excuses, and a need to follow-up in having the foster children psychologically and physiologically examined. The system knows that for the most part the foster child became a victim of an individual who had authority over them e.g. their father, step-father, and, etc., and for some unknown reason the mother or father of the child decided not to protect the child, resulting in the child’s removal and placement into foster care.
This is commonly seen where the mother doesn’t believe her daughter for whatever reason(s) and will not ask the father to leave the house. The criminal justice system has no other choice but to intervene and remove the child from an environment where she is no longer safe; she needs to be protected from the alleged perpetrator.
The problem the criminal justice system faces is in the foster care program the protocols and procedures for children who are placed into the foster care system (due to time constraints) there is minimal emphasis on having the child evaluated (prior to placement) to ascertain if the child may be a danger to their peers or children in the foster care home.
Most counseling and therapy for the foster care child is developed by the child protective service caseworker with the assistance of the foster care parents. The program allegedly surrounds the needs of the child and upon being placed into the foster care system begins the counseling and therapy process. However, all of this takes time and the child may not understand that sexually touching another child is not appropriate.
A policy should be developed and instituted that when a child is a sexual assault victim and she/he is placed in a foster care home where children of the same age or younger are already present, than an immediate ‘danger assessment’ needs to take place. The theme should always be if other children are present their safety needs to be the number one priority, under any and all circumstances. Failure to abide by this policy and process should bring major consequences for anyone in the criminal justice system who has the responsibility of placing children into an environment where other children are put at risk.
Becoming a foster care parent can be intense as the background which is performed on the individuals is productive, complete, thorough, and etc. Decades ago the applying foster care parent could be a foster care parent by simply putting down in the application they had never been arrested. This application was too simple and allowed pedophiles to enter the system. sexual assaults to occur in the home due to the lack of supervision, neglect and inhumane issues, new applications and approval protocols and procedures were put into place. Still there will be applicants who will slip through the cracks; no system however stringent will be perfect.
The reality of the foster care system is things don’t always work out in the manner they should. The problems which are many may include the false allegations made by a foster child that one of the parents allegedly sexually assaulted them. Once the allegations have been investigated and the parent is exonerated of the criminal charges, the one time foster care parent will not return to this profession. This is unfortunate as the program needs experienced, educated, and trained foster care parents.
Examining statistics in the foster care system provides a different analysis and clear understanding of what the foster care system is all about. In an article written by Donna Gillespie Foster (2000) titled, “Fostering the sexually abused child” states, “My family fostered for seventeen years and at least 60% of the children were sexually abused. Some of the social workers knew this up front and shared this information with me. Others didn't know, and I only found out through the behaviors of the children and things they said.”
Gillespie’s article is disturbing in that depending on who the social worker was she would decide to tell her which child was sexually assaulted and which child wasn’t. Failure to advise the foster care parent that the child they are placing in their home had been sexually assaulted is like putting a stick of dynamite into her coat pocket as she walks into the foster care placement.
There are three reasons why foster care parents need to know why a child has been sexually assaulted. They are:
1.      If a child has been sexually assaulted then their behavior may include sexually acting out towards adults or children in the home. Further, the child may have emotional, mental, and physical issues that the foster parent can’t deal with if they have no knowledge that the child was assaulted or neglected.
2.      If a child has been sexually assaulted she may create a cycle of sexual assaults where she either sexually assaults peers or the younger children in the home. Her manipulative ways may be threatening not only to the other children in the home, but to the foster care parents. A well-meaning foster care parent may be manipulated into doing something for the child that he/she would generally not do.
3.      If a child has been sexually assaulted she may become a victim of one of the foster care parents who would generally not have sexually assaulted a child, but the child in her presentation attempts to be sexual towards the parent and in return the parent sexually assaults the child. The child may fall victim to other sexual assault child victims in the home for a multitude of reasons. The child may believe that sexually touching amongst the other children is socially acceptable and is unable to draw boundaries which are appropriate or inappropriate. The child may become aggressive and prey upon the weaker child, especially those children who are placed into the home for similar reasons and are emotionally and mentally imbalanced from being sexual assault victims.
There is no doubt that the foster care system struggles in the manner in which it is structured, organized, and operated. The foster care system has been established for decades and over the years the programs and the people who work within the guidelines, protocols, procedures, and

 policies have had to learn how to make changes when needed and necessary.
Credit should be given to the criminal justice system which works hand in hand with the foster care programs. There needs to be continual support for those who want to be foster care parents and those who already are, support and praise should be given to them on a daily basis. Law enforcement officials, child protective service case workers, counselors, therapists, medical personnel, and others who make the foster care program function are brave, courageous and deserve everyone’s support.
No system is ever going to work perfectly. In the foster parent care system children for the most part are given the opportunity to live in an environment which is safe and free from violence, mental and emotional abuse, and inconsistency of someone who cares and loves them. Sometimes children who were severely sexually assaulted may in return sexually assault their peers and younger children in the foster care home. Steps need to be taken to reduce re-victimizing a child who is in the home because she/he was sexually assaulted and needed a safe haven from being sexually assaulted.
Psychological assessments need to be performed as soon as possible of children who are victims of sexual assaults. There will always be children who are placed in a foster care home for other reasons than sexual assaults. However, this child may need attention until she/he is assessed as if they were a victim of sexual assaults then they may become the perpetrator. In any and all foster care situations it is important that children are protected and live in a safe environment.

Having grown up in Louisiana I can feel their pain as people look at what they have lost, and not having shelter and food as winter sets in with the arrival of this storm. This is also as we round the corner to the Christmas Holidays, so please find it in your heart to donate and help the victims of this storm recover, as in the spirit of the holidays upon us, we all need to do our part to help these victims!

Over the past three decades there have been a multitude of individuals and organizations which created policies and procedures in how they will conduct interviews of child sexual assault victims. Historically, the theory has been that a child who may have been sexually assaulted should be interviewed as minimal times as possible. The reason for this thinking is the legal process can be intimidating and traumatic to the child. The ideology of conducting one interview of the child never made since then and it doesn’t make sense today.

These individuals and groups are now considering changing this policy to allowing alleged child sexual assault victims to be interview two times. This seems insignificant as well, since two or four interviews may not allow the child to fully disclose specifically what transpired between the alleged victim and perpetrator. Each child is unique and there are many reasons it may take several times to interview the child to find out the trauma they have endured.
When interviewing children under the age of nine, their attention span is basically 20 to 30 minutes before they become exhausted from the questioning and begin to shut down. Therefore, interviewing the child multiple times seems reasonable and logical. Experts in this field should not set a number for how many times the child should and can be interviewed. Each child is different and sometimes when they are brought to the interview location they like everyone else may not be in the mood to talk, especially about something that may have allegedly happened to them; something traumatic.
Law enforcement took a back seat decades ago in their role in interviewing children who may have been sexually assaulted. To date there has never been an explanation, research, or studies which demonstrate, suggest, or point to the reason law enforcement officers are not capable of conducting child sexual assault interviews.
Training and education of how to become a competent and intelligent child sexual assault interviewer is available nationwide for child sexual assault interviewers, child protective service workers, law enforcement officers, and etc. If the training and education is available for everyone in the criminal justice system then the reasons for law enforcement failing to be responsible for performing the interviews is not reasonable or logical.

On the West Coast there is one man who is a forensic interviewer, but outside this individual the majority of child sexual assault interviewers are women. The majority of women being interviewers could be an issue in that the child sexual assault industry which promotes woman to be interviewers. However, in the United States there are one million police officers and there are only 12 percent are women. Most of the child sexual assault interviewers are civilians, working for the county prosecutor or private agencies.
The women in law enforcement for the most part are assigned to detective positions as they have the character
istics, traits, flexibility, and skills to deal with a multitude of positions such as VICE, narcotics, special assaults, and etc.
The current foundation of who will interview the alleged child sexual assault victim has seen child advocacy centers developed, established, and built to meet the needs of the community; specifically children who have been sexually assaulted. These advocacy centers have the criminal justice agencies such as law enforcement, child protection services, medical personnel, and child sexual assault interviewers working in the same facility. It is like a one stop facility which allows the child to get to know the team they will be working with during the criminal prosecution and a many other reasons.
Still there has been little to no advocation for men to be child sexual assault interviewers or for law enforcement to take back the role of the child sexual assault interviewer. Law enforcement deals with a diversified population in their specific assignments dealing with children, young adults, and adults. The reason this is important is law enforcement have the basic and advanced training in how to interview everyone who becomes involved in the criminal justice system.
One of the key issues in interviewing child sexual assault victims is the training and education civilian child sexual assault interviewers receive provides a foundation for them to perform the interview. However, where this process falls short is they do not have the necessary police experience to enhance their abilities to perform thorough, complete, intelligent, and competent interviews.
It seems there is this ‘blockade mentality’ that a civilian employee who has no police academy training, patrol experience, investigative experience, basic and advanced interview skills should be the only group not interviewing children. ms the child abuse industry has become an arena of women who have set up a process which has eliminated men from participating in an area where the law enforcement officer has the training and education to perform such interviews; but are rarely provided the opportunity to be a child sexual assault interviewer.
In the early 1980s women victim advocates did not want uniformed law enforcement officers interviewing potential child sexual assault victims. The reasons for them not to interview child sexual assault victims that were listed were, (1) the police uniform was frightening to children and (2) the law enforcement officer doesn’t have the experience to perform an interview of a child who may have been sexually assaulted.
These two reasons appear to be ignorant and naïve as law enforcement officers perform the interviews of adult rape victims. The difference between children and adults which is argued by the researchers in the child sexual assault industry is that both, children and adults are as suggestible as each other. Therefore, if law enforcement performed the interview of a child victim then the concern that law enforcement may ask a leading and suggestive question would seem not to be a concern because of this research. The other reasons women victim advocates stated were law enforcement officers don’t want to interview child victims; officers are not sensitive enough; officers may not believe the child; and other reasons.
Over a period of time the law enforcement investigator who is assigned to the specialized unit will become familiar with what facts and evidence support a criminal charge against a perpetrator i.e. someone who sexually assaults a child. Further, if they are familiar with what facts and evidence are needed to criminally charge a perpetrator then they would know what information they would need from the alleged victim. The type of questions and manner in which the questions should be asked is very important and an experienced law enforcement officer who is trained and educated in interviewing child victims, witnesses, and perpetrators know how to conduct the interviews. The interviewing of witnesses no matter what their age, race, or gender is one of the most important aspects of performing their job. Officers expend the majority of their time during their daily tour in talking to all types of people.
Generally, when it comes to civilian child sexual assault interviewers performing the child sexual assault interviews, prior to the interview they are provided the name of the alleged perpetrator by the law enforcement investigator assigned to the case, so they may question the child about the alleged incident.

Most of the time the child sexual assault interviewer will receive minimal information about the facts of the case from law enforcement investigators. Although the child sexual assault interviewers are trained to obtain the facts i.e. who, what, when, why, where, which, and how, from the alleged child sexual assault victim, important information may be missed due to the lack of knowing the case facts and evidence. If the law enforcement investigator begins the case upon assignment, performs all the interviews, including the child interview, the case should be complete, thorough, intelligent, and competent and ready to be presented to the prosecution for the filing of criminal charges.
A judge and jury want to know what the child has to offer reference what occurred between the child and the alleged perpetrator. When an incompetent and unintelligent interview is performed by a child sexual assault interviewer, the child may have provided minimal information to the interviewer. This may occur because the relevant and material questions were not asked during the child interview. Failure for the child sexual assault interviewer to know and probe the alleged facts and evidence may bring questions from the judge and jury about the child’s credibility, reliability, and veracity.
Most civilian child sexual assault interviewers have little to no experience in testifying in a court of law. Depending on the interviewer the lack of experience may be conveyed to the judge and jury that the interviewer did not follow protocols and procedures when interviewing an alleged child sexual assault victim. Most child interviews are digitally audio and video recorded therefore, it is difficult for the interviewer to have done something unethical, which should enhance the interviewer’s credibility with the judge and jury.
In conclusion, the need for the child sexual assault industry to reevaluate how the child interviews are being conducted should definitely be a major priority if not now, but in the immediate future. The lack of male interviewers and the lack of law enforcement investigators performing child se
xual assault interviews appear to be an antiquated practice and gender bias. These issues need changing to advance the new child sexual assault interview methods and techniques which provide guidelines for how a child sexual assault interview should and needs to be conducted. New protocols, procedures, and processes will bring integrity to a system which constantly needs improvement, creativity, and innovation.

Auto Insurance America is an insurance company serving Arizona, Nevada, and New Mexico; they provide renters insurance, automobile insurance, watercraft insurance, motorcycle insurance, RV insurance, mobile home insurance, and homeowners insurance.

The company has been in business since 1972 and offers automobile insurance for both "clean record" drivers and those with less than stellar driving records.

Because the company has been around so long with the same management, it's impressive that they can be a reasonably priced insurance company with competitive rates even as compared to more cut-rate companies.

An Overview

Auto Insurance America is a good basic company with decent coverage no matter who you are. They also offer special coverage for those with DUI records, something many insurers don't do. Additionally, they offer senior citizen discounts and special "monthly birthday discount" pricing for those under 30 who normally have to pay higher rates.

You do have to be careful to read policy requirements, because, for example, some have complained that their policies have been canceled for car-pooling, or have complained that customer service is less than stellar. Nonetheless, these are practices many companies follow in that if you're carpooling, for example, you may not have coverage for everyone driving or using your vehicle.

Therefore, specific types of coverage may have you as the only one able to drive your car if that's the insurance policy you chose. As to customer service, many people are cutting back on customer service costs as a means to save money. This is a trend across the business industry, not just insurance, and therefore customer service problems may be more apparent across the board then was once true.

Be careful to check rates and do some comparison-shopping

Although Auto Insurance America does have decent rates for most people, do comparison shop between companies even so. You may be able to find better coverage for less money, although some of the amenities Auto Insurance America offers may not be available at these rates from other companies, such as coverage for those with drunk driving convictions or special "discount" rates for young drivers.

Convenience of being able to pay your bill online

As with many auto insurance companies today, Auto Insurance America allows customers to pay their bills online, which is convenient and easy to do.

The bottom line?

Auto Insurance America is a decent company with a good customer service record, although these days, customer service may leave something to be desired simply because of the cost cutting measures the company is trying to implement. Because customer service has taken a bit of a back seat, customers have to be especially vigilant that they read policy requirements carefully and follow them to the letter.

Sudden cancellation of policies for things consumers didn't know were forbidden previously (such as the aforementioned carpooling restriction) does happen, and the company does not necessarily warn beforehand. Therefore, be proactive if you do take out a policy with Auto Insurance America, because you're going to have to know the fine print to make sure you don't violate anything in your policy.

The Rights of the Accused: A Case Study of John Doe

“John Doe is an individual that left his country in an effort to make a better life for himself.  However, he does not have legal status in America and was recently arrested for shoplifting, which was valued over $1,000.  At the time of his arrest, John voluntarily began to make incriminating statements to the arresting officers.  At the police station, detectives conducted an interview of John asking him about the theft.  John Doe has had no prior arrests, is 35 years old, and most of John Doe’s family still resides in his home country.  Due to the amount of monies involved, the crime is deemed a felony and John was arrested and placed in the county jail in Toms River, NJ” (  Kaplan University Platform, 2010).  He is going to face the judge in the Ocean County Superior Court; however, he has no money for bail.  We will evaluate the process of his arrest, and procedures following the arrest, to evaluate if John’s rights are being upheld, and along the way, we will explore the procedures involved from arrest through preliminary hearing or grand jury, comparing and contrasting the two. 
Police Procedural Steps
John began incriminating himself voluntarily upon arrest.  Since this was not at the request of the police, they were under no obligation to Mirandize Mr. Doe.  All voluntary information is admissible in court (Osterburg, & Ward, 2007).  The Miranda ruling only covers communication initiated by the police.  Since they arrested him and took him to the police station, he would go directly to booking.  It is proper procedure to read the Miranda Rights, along with being asked, to sign papers stating that his rights were properly explained to him, and it is at this point that pictures, fingerprints, suspect address information, date of birth, along with weight and height measurements.  When police do question him, although the rights have already been read in booking, it never hurts to read them again.  The Miranda Rulings deal with the admissibility of confessions in the courtroom (Roberson & Stuckey, 2007), and do not imply law enforcement procedure.  (Schmallinger, 1991)
Initial Appearance (Arraignment)
After the police interview John, there must be a formal Complaint issued, which contains the name of the accused, the nature of the offense, and the date and time of the offense.  Once this is issued, the next step is the initial appearance before a magistrate or judge, or more formally, the arraignment.  During this arraignment, the charges are formally read to the defendant, and a plea of guilty, not guilty, not guilty by reason of insanity, no contest, or once in jeopardy will be made.  It is also at this stage that the court will appoint John an attorney from the county free of charge, because of his inability to pay.  The Fifth Amendment guarantees the right to defense counsel regardless of the ability to pay for one.  This was decided in the landmark case, Gideon v. Wainwright.  Bail will be discussed now as well.  When considering  bail, the judge would have to weigh the seriousness of the crime, the weight of evidence against John, and whether or not he has binding ties to the community, along with the criminal history, and whether he has any previous failure to appear issues.  We know that most of John’s family is in Mexico, and that he has no binding ties to the community; however, he has no criminal record at all.  It is up to the judge to determine if John will be allowed bail based on the weight of these circumstances.  (Roberson & Stuckey, 2007)
Preliminary Hearing or Grand JuryHearing
The court could choose to hold a Preliminary Hearing, or a Grand Jury Hearing.  There are advantages and disadvantages to both.  In a Preliminary Hearing, the judge decides whether there is sufficient probable cause and or evidence to accuse the defendant of a crime.  The Grand jury does the same.  This is where the similarities end.  If probable cause is found during a Preliminary Hearing, the defendant is bound over for trial, where in a Grand Jury Trial they would return a formal indictment against the accused.  Preliminary Hearings are open to the public, and, are held in open court.  Grand Jury Proceedings are held in closed-door sessions, held in secret.  While Preliminary Hearings are formal judicial proceedings, and are adversarial, meaning that both the prosecution and the defense are allowed to present their evidence and cases, Grand Jury Sessions are informal.  The prosecution is the only side that they hear.  The defendant has right to attend and present evidence at Preliminary Hearings, but is not allowed at all in Grand Jury Proceedings.  Another difference between them is that the Grand Jury holds powers that the judge or magistrate does not.  These are the power to conduct their own investigations, subpoena witnesses and documents, and to grant immunity.  (Roberson & Stuckey, 2007)

One advantage to a Preliminary Hearing is that it might bring about a dismissal, conclude that there is insufficient evidence to charge the defendant, or have the charges reduced to a misdemeanor due to lack of felony evidence.  Another advantage to this type of hearing as opposed to the Grand Jury is that the defendant can waive this right, resulting in him receiving a quicker trial date if he wants to get the process over faster, and when he does this, it limits the charges to whatever is already existing in the Complaint filed.  (Roberson & Stuckey, 2007)
The Grand Jury is a safeguard to the accused, and is guaranteed in the Fifth Amendment that everyone has the right to a fair trial.  An advantage to having a Grand Jury Process is that the Grand Jury is composed of sixteen to twenty-three members of the community, which is supposed to represent the defendant’s peers.  This method would be considered the fairest, since judges and magistrates can be paid off without this safeguard in place.  This keeps our system as honest as it can be considering the nature of man. (Roberson & Stuckey, 2007)
Conclusion
Since John was arrested, and promptly taken to the police station, even though he talked before he was read his rights, the police followed proper procedure in listening to his voluntary words, because, they were initiated by John.  He was booked at the station, and then interviewed and then the police set up his arraignment.  Depending on the state laws in New Jersey, he will either, receive a Preliminary Hearing, or a Grand Jury Proceeding.  If, enough probable cause is found, John will then go on to trial.  The fact that John is in the country illegally probably hindered his chances for bail because he has no ties to the community, but it also means that when he is sentenced, deportation maybe a choice he has to avoid jail time.  That is at the discretion of the judge, because if it is not made a part of his sentence, when his time is done for the crime, he will be turned over to ICE, which is the agency that deals with illegal immigrants in this country, and probably be deported anyway.
