Today’s Investigative Special Report – January 17, 2013 “Dealing With Todays Law Enforcement Specialized Investigations” “Would Retired Law Enforcement Be The Answer To Protect Children?”

 Of the 100,000 school districts in the United States there are 10,000 school districts which have hired over the years retired and off-duty law enforcement officers and security to protect students in a school environment. The major question is “How is this working for everyone across America?” This sounds harsh but is simply a reality. It isn’t working nor will it continue to work as long as the politicians and law makers focus on what type of a gun an individual owns. This ideology is antiquated and all studies have demonstrated that gun restrictions do not have anything to with when and where they are used, and on whom.

It seems every day now another shooting is occurring if not at a school, but a business environment. Basically, the mentally violent deranged animals are out of their cages and people have become their targets making them the shooting victims.

Parents and others want their children protected when in a school environment. However, this is the ‘band aid’ effect, where placing the ‘band aid’ on the problem will never stop the problem. Politicians want Americans to believe that if they restrict the type of guns which individuals have the right to own under the Second Amendment, there will be a change in people’s behavior.

Restrictions on what types of guns can own may be a method to stop the madness. Unfortunately, this does not address the major issues which are as follows:

1.      How does the government stop individuals who have criminal records from obtaining a gun?

2.      How does the government stop individuals who have no criminal records from obtaining a gun and shooting people?

3.      How does the government monitor and control the mentally violent deranged individuals who are become obsessed with their guns and accessories and want to and do murder people?

4.      How does the government say no to individuals who may be mentally violent deranged individuals who are legally capable of obtaining a gun, but the seller believes the sell is a bad idea?

5.      How does the government make people who are in possession of illegal guns to register such guns?

The above questions are just the beginning of asking those who are gun owner’s questions which the government somehow in their wisdom may be capable of obtaining the information and then having all of those who have the illegal guns register them. The fear that the government wants everything they have from property to guns to money is something which continues to spew out of the white house which is alarming and a different subject matter.

The government wants people who sell guns to be psychologists. They are not trained to be psychologists nor do they want to be the gun police. If they don’t want to abide by all of the laws then there is a problem. The seller does not have the education, training, or experience to make a decision about who should own a gun or who should not.

 from purchasing and owning a gun. The seller can have an individual fill out a form and then fax or email the form to those who perform background checks and they either deny or confirm the purchase.

President Obama and Vice-President Biden want the gun lawsto be about the protection of children. If this ideology is the road President Obama wants to travel it will become immediately obvious that no matter how many gun laws are passed, people will find the guns they want to own. The mentally violent deranged individual who has a monomania problem will kill whomever he has targeted and then he will turn the gun on himself.

There is no way to stop these types of individuals in doing what they have planned and set-out to accomplish. Trying to understand who these individuals is a simple process as the Federal Bureau of Investigation (FBI) has a Behavior Unit which profiles and has profiled these individuals. So what does the FBI profile say about these people; who are they and how can they be stopped? Great question, but no one including the FBI has any way of predicting behavior of a specific individual unless the individual comes under their radar. This is the catch, how does law enforcement identify and apprehend the mentally violent deranged individual before he enters a school and murders innocent children.

The preventive aspect of the awareness of who these murderers are needs to be posted on every telephone from the west coast to the east coast.

Under the new gun laws which are being introduced to restrict the types of guns people may own, therapists now have to report individuals who they are concerned pose a threat. This bill doesn’t go far enough. What the law needs to include is this mentally violent deranged individuals family, relatives, friends, peers, and basically anyone who identifies that something is not right with this individual, especially someone who in a short period of time is obtaining numerous guns, the types of guns, and ammunition which a person could fight a war with, needs to be reported immediately to law enforcement.

The utopia of what President Obama wants to change to, simply will not work. It isn’t the criminals killing students it is law abiding citizens who are killing students. These individuals are the individuals who have the right to purchase any guns and accessories and as many as they want. In fact, the person killing people have a psychology of personalities. These multiple personalities make it difficult for law enforcement to identify them, apprehend them, and etc.

In the movie “The Minority Report” the actor Tom Cruise plays a law enforcement officer and during this futuristic movie law enforcement has created a criminal justice system which identifies a future criminal act. This allows law enforcement to stop the crime from occurring. Everything goes well until Cruise is identified as someone who will commit a crime in the future.

Today, “The Minority Report System” does not exist and to date no one has created such a similar system which would stop people from committing a crime. Therefore, America has to deal with the current system in which there are no fortune tellers of future criminal behavior. Our only asset is the FBI and other professionals in the law enforcement community can profile people, when others are not yelling about being discriminated against or having their rights violated. However, it is reasonable and logical that if a life can be saved then law enforcement must do whatever makes common sensical and doesn’t violate the Constitution.  

Restricting gun control by passing laws which outline which gun an individual can own will not stop the mentally violent disturbed from killing any one. What is needed is education and training to make people aware that the professionals, the experts, and those who understand violence need to begin educating the public in the type of atmosphere which promotes accountability and responsibility of the protection of themselves, children, and others.

No one can protect the future and President Obama’s actions are admirable, but in the end will not be sufficient. If he is going to expend time and money on how to curtail or prevent future shootings, he needs to create a Gun Czar who will begin a nationwide education program which is “effective.” He can establish State Agencies who have individuals who have the authority to establish and hold city meetings where people can come to hear how to protect themselves and their children. Further, a prevention videotape needs to be created to be posted all across the Internet especially YouTube and Google, which does the following:

1.      Establishes just who these mentally violent deranged individuals are. Taking the FBI or any other professional violent expert’s profile which educates people about the psychology of personalities of who they are. Simply, people need to open their eyes, know who the people are who play a role in their lives, and report any odd and illicit behavior. The title of being a “snitch” should be something the community supports and advocates.

2.      Establishes specific training for current or former law enforcement officers or security guards on how to handle one of these mentally violently deranged individuals. This program needs to be put into effect right now. The assumption that because the retired or off-duty law enforcement officer knows how to deal with school violence is a mistake Americans can’t and shouldn’t make. In small towns in America law enforcement agencies do not have the ability or finances to properly, completely, and thoroughly train their officers. The Federal Government which finds itself financially underwater because of the over spending of the past and current administration need to find the money to support these law enforcement and security education and training programs.

3.      Establishes media coverage of who these mentally violent deranged people are. This is not naming names, but teaching Americans what the signs are to look for. Further, that if it is determined at a later time that they knew this individual was demonstrating “concerning” behavior, e.g. collecting guns and ammunition, acting odd or violent then they will be prosecuted to the fullest if they don’t take the necessary steps to contact law enforcement about what they have observed. It is time to make people understand the need to call law enforcement when things just don’t seem right.

4.      Establishes programs which eliminate politicians from using children to attempt to influence others that people possessing specific guns is the problem and the reason there are shootings at schools. The problem is not this simple to understand and to stop. It will take a community of all to change things. It will take all Americans to step forward and do their part. It will take law enforcement much time to educate and train themselves and others that mentally deranged individuals generally behave in a specific way.

5.      Establishes programs which teach individuals how to dial 911 when an individual is beginning to concern them. This does not mean to call law enforcement because someone put garbage in the wrong bin. This exactly means when the actions of others are concerning they need to call the police. Professionals in the community can educate and train people how and when law enforcement needs to be called. The information can become a trickle-down effect where everyone is learning and reporting. Always remember the past mentally violent deranged murderers were known in their community as being “special” something being different or wrong with their family member, a friend, a co-worker, and etc. Someone knew something again was not right with this individual, but nobody reported their behavior to law enforcement.

President Obama should take the time to communicate with Congress that he needs their assistance in building an education, training, media campaign in “Prevention, Recognition, and Reporting Program” of how to identify these mentally violent deranged individuals and how Americans can report their behavior to law enforcement.

This “Prevention, Recognition, and Reporting Program” will allow educated and trained retired and current law enforcement officers in how to investigate any complaint of a possible mentally violent deranged individual acting odd, different, or unusual.

Tomorrow when President Obama’s signs all the Executive Orders reference gun control and restrictions, it will only be a matter of time to demonstrate that this avenue of gun restrictions was the wrong road to take. I pray and hope that he is right and I am wrong. To date too many ch

ildren lives have been taken away. There can be no reason or excuse for the taking of an innocent life no matter what their age is.

The answer isn’t politics, the us against them mentality i.e. Democrats versus Republicans. However, it is about protecting everyone, and it all begins with law enforcement being responsible to protect and serve their community by establishing a strong “Prevention, Recognition, and Reporting Program.” It is time to educate and train law enforcement officers in how to recognize mentally violent deranged individuals, how to handle them, how to avert a deadly situation, and how to resolve conflict without the loss of life. The community must partner with their local, county, state, and federal law enforcement officials in finding anyway to communicate that someone they know just might be a danger to himself and others.

Today’s Investigative Special Report – November 13, 2012 “Dealing With Today’s Law Enforcement Specialized Investigations” “Where Does Law Enforcement Fit In?” Former CIA Director Petraeus and President Barack Obama in the Thick of the Benghazi Investigation

What role did law enforcement play in the Benghazi, Libyaand Director David Petraeus’s matter? It appears the Federal Bureau of Investigation (FBI) has been involved in both situations. To date the role and results of the FBI in the Benghazi investigation is unknown. Though in the Petraeus’s matter it appears they have been and continue to investigate several individuals.

Today the Whitehouse continued to dodge what specifically the FBI performed in their lengthy investigation of the Petraeus situation. When asked by a reporter today what has been transpiring with the Petraeus situation Jay Carney, the Whitehouse Press Secretary, referred him to the FBI. Instead of answering the question the Whitehouse continues to allow the cyclical lack of information.

The recent discovery that CIA Director David Petraeus resigned on Friday, November 9, 2012, from his position ‘citing personal reasons for the resignation.’ The personal issues surround the FBI’s discovery that Petraeus was having an affair with his biographer, Pamela Broadwell. Allegedly, Broadwell had sent some threatening and intimidating emails to an employee inside the CIA, Jill Kelley, a family friend of the Petraeus’s. This past week Broadwell’s residence was raided by the FBI. Previously Broadwell was interviewed by s
omeone in the FBI. The results of the interview with Broadwell are unknown.

The resignation comes at a time where Petraeus was to testify on Thursday, November 15^th in front of the Senate Intelligence Committee. Since Petraeus submitted his resignation the social media has focused on him not wanting to provide testimony to the Committee about his and everyone’s action in reference to the murder of four Americans at the Consulate in Benghazi, Libya on September 11^th.

There are many hypotheses which should be considered reference why Petraeus submitted his resignation on Friday and why he now is refusing to testify in front of the Senate Intelligence Committee. They are as follows:

1.      Taking one for the team. It is always possible that Petraeus has agreed to take the responsibility for what happened in Benghazi. This is highly unlikely, but must be considered. The need for President Barack Obama to be as far distant from these murders is important. There are several reasons for this as the manner in which Americans have received information from the Whitehouse has been confusing, misleading, not forth-coming, and so forth. The President has been associated with or promoted much of the misinformation according to many reliable sources and social media outlets.

2.      Petraeus’s resignation may have nothing to do with the timeliness of him having to testify. The issue and analysis of the timeliness of the resignation has many people asking the question about the coincidence of why now since the FBI allegedly knew about the extramarital affair six months ago? No matter what the Whitehouse has to offer in way of an explanation it is difficult for people to believe they had nothing to do with one another.

3.      If Petraeus testifies the information he may provide may put the President in vulnerable and precarious situations. The need for Petraeus to testify is relevant and material because he knows who knew what. In the debate with Representative Paul Ryan and Vice-President Joe Biden, Biden stated that he and the President did not have any knowledge, he said, “…we weren’t told they wanted more security” at the diplomatic facility in Benghazi.

4.      It appears the allegation of Petraeus and Broadwell having an extramarital affair is true. However, the sex scandal appears to be driving the politicians from moving from the Benghazi incident to focusing on Petraeus. It seems reasonable and logical that both Petraeus and his extramarital affair with Broadwell are inter-related. How at this time is unknown.

There are numerous times where the President made statements that he knew nothing about what had occurred early on in Benghazi; that what occurred was in response to a videotape and they are investigating the matter. When the President spoke in front of the United Nations he repeatedly blamed the death of the four Americans on the videotape.

Further, the President did not call the act a “terrorist act” until many days after the incident. Although he did state that our country would not stand for terrorist acts. He didn’t directly state that the incident in Benghazi was a terror act. On Sunday, two days before the presidential election, CBS News released a video clip that provides an interesting dialogue. The clip is from President Barack Obama’s Sept. 12 interview with Steve Kroft of 60 Minutes. The newly released clip includes this exchange between the reporter and the president.

KROFT: Mr. President, this morning you went out of your way to avoid the use of the word terrorism in connection with the Libya Attack, do you believe that this was a terrorist attack?

   OBAMA: Well it’s too early to tell exactly how this came about, what group was involved, but obviously it was an attack on Americans. We are going to be working with the Libyan government to make sure that we bring these folks to justice, one-way or the other.  

In the debate with former Governor Mitt Romney, he told President Obama, “I want to make sure we get this for the record, because it took the president 14 days before he called the attack in Benghazi an act of terror. The President responded by check the record. Social media outlets did check the records and the President was mistaken.

5.      During his first Presidential term, President Obama has not used the words “Terror, Terrorism, or Terrorists. The reasons will not be known why he will not use these words until years from now. His Presidential campaign surrounded the theme that his administration had Al-Qaida on their heels, using the death of Osama Bin Laden as an indication for his opinion. The explanations are yet to have been revealed at this time why the President is leading the country in this manner.

6.      If the resignation of Petraeus would have been disclosed to the public prior to the Presidential election the information may have been harmful to Presidential Obama’s re-election bid. Former Governor Mitt Romney may have been able to use this information along with the other leadership problems in Obama’s administration during his first Presidential term. There appears to be a multitude of problems from the GSA to Homeland Security to Attorney General’s Office to the partying of CIA Agents and etc. There seems to be a pattern which has taken place during the President’s first term in office.

7.      President Obama’s reputation as an “ineffective leader” is something he does not want to be an aspect of his Presidential Legacy.

8.      The reasons for the FBI investigating Petraeus is something which would not be dealt with without the authority of the President. According to the social media outlets, the allegations about Petraeus having the extramarital affair were known by FBI Director Robert S. Mueller, National Intelligence Director James R. Clapper, and Attorney General Eric Holder.

9.      It is illogical and unreasonable to believe that the first time President Obama heard about the allegations against Petraeus was on Election Day. This is not how the President operates nor would those working for the President would have kept this information from him. The President would have immediately been made aware of the situation as soon as one of these three Directors was made aware of the situation.

10.  President Obama gives the appearance that he runs a tight ship and for him not to have known weeks or months in advance what was occurring with Petraeus prior to receiving his resignation is simply naïve and ignorant. There is an established chain of command which is in place for just these types of situations.

Once the extramarital affair was uncovered there would have been a time of meetings between the parties involved in the situation. President Obama and his advisors would have held meetings to determine what would be the best course of action.

If the FBI was truly investigating a complaint by a CIA employee, there will be an established timeline supported by written documents, emails, witness interviews, meetings, phone conferences, and any other type of facts and evidence which was uncovered. This is where the President needs to be careful about his rendition of when he became aware of Petraeus’s extramarital affairs, as well as his role in the Benghazi incident. Some social media outlets have alleged that Petraeus had been under investigation for some time, but the reasons for the investigations have yet to be made known to the public. It is possible the investigations by the FBI will never be made public citing confidential and national security reasons.

The investigation of the Benghazi incident and now the resignation of Petraeus continue to be a law enforcement issue. The investigation should be performed by law enforcement experts in the field to analyze all of the information from the beginning of both of these situations to today. The timeline will establish who was involved, who knew what, when they became aware of the information, who made decisions, and so forth.

Apparently the committees will continue to be the ears and voice of the people. Backdoor dealings or the appearance of any backdoor deals should and will cause the public to ask further questions about what happened and who was responsible. Petraeus may not appear for his scheduled testimony, but the committee does have subpoena power and may be able to force him to testify.

The Benghazi incident occurred over nine weeks ago and there has been too much happening in reference to obtaining the necessary information about what happened on September 11^th. Specifically, what has happened since the event, and what roles everyone played prior to, during, and since? The investigation by law enforcement, which ever agency is responsible for both investigations is not complicated and the convoluted manner in which this has been handled to date is incompetent, unreasonable, illogical, and lacking in the basics of a law enforcement investigation. The Committee needs to quit complaining about the resistance they have received from the State Department and the Whitehouse and begin unpeeling the layers of bureaucratic nonsense.

As of today, which law enforcement agency is doing what is unknown? It is a guessing game of who is the leader of the investigation. A strong leader is necessary someone who has the ability to process the information and guarantee Americans are being told the truth and all of the facts. As the information comes to light, there will be a better understanding of what happened in Benghazi and with Petraeus.

Today’s Investigative Special Report – November 10, 2012 “Dealing With Today’s Law Enforcement Specialized Investigations” “Is The Integrity Of Law Enforcement Hurt By Extramarital Affair By The Top Spy CIA Director David Petraeus?”

Yesterday President Barack Obama, citing using poor judgment by having an extramarital affair with his biographer, Paula Broadwell, accepted the resignation of top spy CIA Director David Petraeus.  The resignation comes at a time when Director Petraeus was to testify in front of the Senate Intelligence Committee November 15, 2012, who are investigating the bombing of the consulate in Benghazi, Libyaon September 11, 2012. According to Petraeus he does not intend to testify in front of the committee at this time. Allegedly interim CIA Director Mike Morell will be taking his place and will testify in behalf of Petraeus.

The question is being raised that the timeliness of the resignation questions specifically what Petraeus may be trying to hide and is a ploy by the Whitehouse for him not to testify. The Committee must make the decision to subpoena Petraeus to testify and this is something the Committee will have to decide at a later date. However, Americans need to have closure on the Benghazi incident where four Americans were killed. New reports indicate the FBI was investigating another matter when they came across the extramarital affair.

Each time there is a scandal dealing with politicians and government officials, who are in the law enforcement profession, later cause all law enforcement's integrity to be placed in question. The average citizen generally can’t compare how the Top Spy in America somehow affects the law enforcement who works in Seattle, Washington.

Most Americans view law enforcement officials in a compartmentalized paradigm, where either they are eating donuts and drinking coffee when crime is being committed in their community or are pursuing women single or married. There is a risk to the reputation of law enforcement officers no matter what their position is.

The average law enforcement officer who has an extramarital affair is not something which the community reads on the front page of the local newspaper or news show. It just doesn’t seem that important. However, it may be something which is serious and can’t be tolerated by the community or law enforcement officials.

If a law enforcement officer has sex on his mind, then his focus is not on the responsibilities of his job; which is to protect and serve. He avoids the reality that his improper actions have consequences and sooner or later his behavior will eventually ‘leak’ out and then there will be an accounting.

The integrity of law enforcement officers is a serious issue in that there is more to the event of an extramarital affair. If those in the law enforcement profession are known as an individual who lack common sense and expends his time on the job chasing women, he will be judged and viewed as lacking integrity. He disrespects the uniform in which he wears and generally once viewed as a disrespectable and indecent human being others look down their nose at him and wonder what he was thinking. This is one of the main questions being asked of Petraeus.

Sooner or later the mud slides far enough downward where it takes everyone who is in the quagmire down the hill where at the bottom stands individuals who will hold the officer accountable for his behavior.

In Petraeus resignation, the media is talking about his wife Holly and that he has been married for 37 years. There is little known about the woman he had the affair with, nor is there any indication that she will step forward until such time that some media outlet or publisher offers her millions of dollars to ‘tell all.’ Moreover, the social media will expend hours trying to draw people out who have knowledge about the affair.

The moral majority will provide advice to others that having an extramarital affair is something which has and will be destructive if you are married. There are no winners when you are sleeping with a man or woman who is married.

The standard of whether a law enforcement officer should be held to a higher standard must be decided by the expectations of the community and law enforcement officials. If there is a ‘moral clause’ in the agreement of employment with the law enforcement agency then there must be a definition for what specifically does the ‘moral clause’ include? If there is no definition then an officer probably will not be held accountable for his extra-curricular activity, unless the improper conduct occurred while on duty.

Law enforcement integrity according to Captain Randy S. Belasic (n.d.) of the Zephyrhills Police Department:

Police integrity is a serious topic that has been the spotlight of law enforcement’s concern for the last fifteen years. Corruption and integrity are germane where corruption is basically dishonesty for personal gain and integrity can best be defined as “the normative inclination among police to resist temptations to abuse the rights and privileges of their occupation” (U.S. Department of Justice, 2005). Integrity can be measured based upon an individual’s moral principles or ethical values.

Did Director Petraeus see the value of the “Integrity which can be measured based upon an individual’s moral principles or ethical values?” In comparing moral principles and ethical values there is this thin line between these principals where the community of law enforcement officers should abide by? Here is a man for 40 years dedicated himself to the United States of America and now with a major indiscretion has lost all that he has represented across his professional and personal life.

The general attitude about who has sex and with who is demonstrated in the number of children being born out of wedlock. Currently two-thirds of children are born to mothers under thirty. Making good decisions about why and who people have sex with has diminished over the past decade. The changing in the attitudes of this new attitude comes from a multitude of reasons.

The percentage of married couples who cheat according to author Lindsay Shugerman is “…approximately 50 percent married women and 60 percent of married men will have an extramarital affair at some time in their marriage.” (Journal of Couple and Relationship Therapy, n.d.)

When taking a broad stroke of the pen when evaluating and examining the Top Spy caught in an extramarital affair, to the integrity of law enforcement officials when it comes to their integrity or to women and men having an extramarital affair may seem like a stretch. The question is, “Is it, really a stretch; isn’t there some correlation between these issues?” Isn’t the attitude of Americans being demonstrated inside the bedroom and who you have sex with is something that appears to be significantly consistent with research and morals.

Law enforcement officers, no matter if it is the Top Spy in America or the law enforcement officer working the streets in Seattle must live by a higher standard than other individuals and professions.  Their integrity, reputation, morals, honesty, presentation, attitude, behavior, and other characteristics, which reflect upon them not only as individuals but as an individual who enforces the law must be above reproach.

There can be no indiscretions, there can be no excuses, there can be no missteps, and there must be a law enforcement code of morality which can never be abused, twisted, violated, or put to question. Obviously Director Petraeus no matter how honorable he was for 40 years in the United States Armed Services or married to a woman (Holly) for 37 years, he has indirectly and directly negatively affected the image of law enforcement officials. The ripple effect of his behavior will have consequences for all who wear the law enforcement uniform who serve and protect their community, especially the men and women in the CIA. The ramifications of such conduct always has a lasting affect and with the facts which came out today it appears Americans have much to learn about his behavior over the past year.

His conduct can only be viewed as extremely improper, inappropriate, and possibly dangerous as he was the leader of thousands of men and women with a magnitude of responsibilities worldwide. Instead of protecting the four dead Americans who died in Benghazi, Libya on the anniversary of 9/11, possibly being preoccupied with Ms. Broadwell, a married woman, may later be determined that his lack of leadership had something to do with their deaths. This statement is written with the hope that this isn't true, but his refusal to testify now speaks highly of what information is unknown to Americans.

In Petraeus’s personal life, his wife is also the victim here and everyone should pray that she will rise above the hurt and pain and move forward from this tragedy.

President Obama has scheduled a visit Keene State College to promote his candidacy for the office of the Presidency of the United State. The crowd is over 1000 partisans who are at the College to support their candidate. There are law enforcement officers at each entrance, special details cover the inside perimeter, and others assist the Secret Service deal with the details of the Senators visibility to the crowd, his entrance and exit out of the college, and other responsibilities.

It is probably an awesome event for someone to attend, but the question is raised reference who is paying for law enforcement to assist the Secret Service in protecting the Senator from the crowd or outside individuals and organizations which want to bring harm to him? This question is one which is complex when trying to answer it.

Depending on the city, county or state law enforcement agencies that provide manpower for these rallies the costs to protect and serve the politician and those who organize a political rally may costs the local taxpayers a significant amount of money.  Therefore, depending on the financial agreement between the politicians and the city, county or state administrators where the event is to take place, there may be a reimbursement for the protection they provide prior to, during, and after the rally.

In the City of Keene, New Hampshire, then Senator Barack Obama and then Senator Hillary Clinton had political rallies at two locations. According to research, both campaigns paid for the hiring of law enforcement officers to handle crowds.  The cost of hiring law enforcement officers is not an inexpensive process. In the City of Keene for each officer hired, it cost the campaigns $56.00 an hour to have a law enforcement officer present and controlling the crowds.

The costs across the nation are similar with some law enforcement agencies being more or less expensive. Most of the hourly wages are determined on what the law enforcement agencies or promoters will have to pay the officers and how much money the city, county or state or promoters want to profit from the event. Moreover, the local law enforcement unions may have a required fee the law enforcement administrators or promoters will agree to pay. Some of the officers hired work their daily shift and then travel to the event where they are assigned a position. This is considered an off-duty job and therefore either the law enforcement agency will pay for the officer’s time, or the political event coordinator/promoter.

The policy when Secret Service requests assistance from the local law enforcement agency, the agency will incur the costs. This policy and procedure depends upon the demands of the Secret Service and the size of the event. The greater the event in reference to the size and the number of people who will be attending may end up costing the campaign or Federal Government.

The law enforcement agency may require specific law enforcement officers to attend and be a part of the training which is necessary prior to the event occurring. An officer needs to know specifically what and where they will be assigned prior to the event. Further, the Secret Service and Criminal Intelligence will have intelligence about potential danger areas, individuals, and organizations that may be a problem prior to, during, and after the event.

Yesterday while President Obama was in the battleground state of Ohio, President Obama found himself on the receiving end of heckling from a pro-life advocate. According to LifeNews.com, “The pro-life protester held up a cardboard sign that read “this moral wrong should never be a constitutional right.” The sign included some grisly photographs of aborted babies.”

In August, 2012, while Mitt Romney was speaking to a group of supporters in Waukesha, Wisconsin on Sunday night alongside his newly selected running mate Rep. Paul Ryan (R-W), was heckled by a protester in the audience. But Romney took the opportunity to forcefully shout down the protester and admonish him for his lack of respect and civility.

Most hecklers at political events are shouted down by the audience and asked to calm down and listen to the speaker. Law enforcement will move in on hecklers who fail to heed the warning which is generally given by the audience or the politician. Hecklers vary from disagreements with the political candidate to just being obnoxious because others will listen to them for that special moment and time.

branch of the federal government, except the president, vice-president, and certain designated high-level officials of the executive branch, from engaging in partisan political activity (Wikipedia, n.d.).

The reason the Hatch Act is of importance is it regulates what a civil employee can and can’t do when it comes to political activities. The Act does not limit one’s right to participate in a political campaign, but their behavior as long as it follows the Act will not cause them any repercussion. Law enforcement officials are limited to what is permissible and impermissible when it comes to their political activities. An example of what is permissible and impermissible is as follows:

It is permissible for officers to:

• Attend fundraisers, display yard signs, or bumper stickers, and attend political rallies;

• Give a speech or keynote address at a political fundraiser, so long as the officer is not on

duty and does not solicit contributions. The invitation for the speech or address may have the

officer’s name, but may not solicit contributions or state the officer’s official title;

• Canvass for votes in support of or in opposition to partisan political candidates or a candidate

for political party office;

• Endorse or oppose a partisan political candidate in a political advertisement, broadcast,

campaign literature, or similar material, so long as the officer is not on duty and not wearing a

uniform, badge, or insignia;

• Run for any nonpartisan office (The entire election must be non-partisan—if any candidate in

the race runs on a partisan ticket, the candidacy of the officer is not permitted under the Act).

A nonpartisan race is not covered by the Hatch Act, and the officer may therefore solicit and

receive political contributions;

• Write a personal check to a political candidate;

• Participate in a committee for a lodge regarding endorsements of candidates, so long as the

endorsement comes from the labor organization and not an individual police officer, and the

duties do not involve personal solicitation, acceptance, or receipt of political contributions.

It is impermissible to:

• Allow one’s name or likeness to be used in campaign literature in the police officer’s

professional capacity;

• Host a fundraiser for a political candidate and recruit attendees using the officer’s official title

(however, a spouse who is not covered under this Act may host such a fundraiser and the

officer may attend, but may not personally solicit contributions to the fundraiser);

• Allow the officer’s name to appear on an invitation to a fundraiser as a sponsor of the

fundraiser or as a point of contact for the fundraiser;

• Engage in campaigning during working hours;

• Use any official authority for influence for political purposes, including using the officer’s

official title or authority to coerce individuals to participate in political activity;

• Run for any elected partisan office;

• Solicit, accept, or receive uncompensated individual volunteer services from a subordinate for

any political purpose. (Fraternal Organization of Police, n.d.)

Law enforcement officials either participate in rallies or are employed by the law enforcement agency they work for or are associated with. However, due to their position in law enforcement they have to and will follow the rules of the Hatch Act. It would seem the Federal Government would try to associate other professions into an Act which monitors and requires specific behavior. However, the First Amendment provides for the right to participate in protests and etc. The issue of which is more compelling, is something which needs to be researched.

Citizens in each community where a political rally occurs need to monitor who is paying for what. In small towns where there are minimal law enforcement officers and their budget is based on local taxes, the campaign and/or Federal Government needs to repay the cities for the expense of having their officers work the political event. It is important to have law enforcement officers in place to protect any politician but the costs if at all possible should be paid by the politician and the event organization.
