Market Impeders and Market Inefficiencies

Even the most devout proponents of free marketry and hidden hand theories acknowledge the existence of market failures, market imperfections and inefficiencies in the allocation of economic resources. Some of these are the results of structural problems, others of an accumulation of historical liabilities. But, strikingly, some of the inefficiencies are the direct outcomes of the activities of "non bona fide" market participants. These "players" (individuals, corporations, even larger economic bodies, such as states) act either irrationally or egotistically (too rationally).

What characterizes all those "market impeders" is that they are value subtractors rather than value adders. Their activities generate a reduction, rather than an increase, in the total benefits (utilities) of all the other market players (themselves included). Some of them do it because they are after a self interest which is not economic (or, more strictly, financial). They sacrifice some economic benefits in order to satisfy that self interest (or, else, they could never have attained these benefits, in the first place). Others refuse to accept the self interest of other players as their limit. They try to maximize their benefits at any cost, as long as it is a cost to others. Some do so legally and some adopt shadier varieties of behaviour. And there is a group of parasites – participants in the market who feed off its very inefficiencies and imperfections and, by their very actions, enhance them. A vicious cycle ensues: the body economic gives rise to parasitic a gents who thrive on its imperfections and lead to the amplification of the very impurities that they prosper on.

We can distinguish six classes of market impeders:

Crooks and other illegal operators. These take advantage of ignorance, superstition, greed, avarice, emotional states of mind of their victims – to strike. They re-allocate resources from (potentially or actually) productive agents to themselves. Because they reduce the level of trust in the marketplace – they create negative added value. Illegitimate operators include those treading the thin line between legally permissible and ethically inadmissible. They engage in petty cheating through misrepresentations, half-truths, semi-rumours and the like. They are full of pretensions to the point of becoming impostors. They are wheeler-dealers, sharp-cookies, Daymon Ranyon characters, lurking in the shadows cast by the sun of the market. Their impact is to slow down the economic process through disinformation and the resulting misallocation of resources. They are the sand in the wheels of the economic machine.

The "not serious" operators. These are people too hesitant, or phobic to commit themselves to the assumption of any kind of risk. Risk is the coal in the various locomotives of the economy, whether local, national, or global. Risk is being assumed, traded, diversified out of, avoided, insured against. It gives rise to visions and hopes and it is the most efficient "economic natural selection" mechanism. To be a market participant one must assume risk, it in an inseparable part of economic activity. Without it the wheels of commerce and finance, investments and technological innovation will immediately grind to a halt. But many operators are so risk averse that, in effect, they increase the inefficiency of the market in order to avoid it. They act as though they are resolute, risk assuming operators. They make all the right moves, utter all the right sentences and emit the perfect noises. But when push comes to shove – they recoil, retreat, defeated before staging a f ight. Thus, they waste the collective resources of all that the operators that they get involved with. They are known to endlessly review projects, often change their minds, act in fits and starts, have the wrong priorities (for an efficient economic functioning, that is), behave in a self defeating manner, be horrified by any hint of risk, saddled and surrounded by every conceivable consultant, glutted by information. They are the stick in the spinning wheel of the modern marketplace.

The former kind of operators obviously has a character problem. Yet, there is a more problematic species: those suffering from serious psychological problems, personality disorders, clinical phobias, psychoneuroses and the like. This human aspect of the economic realm has, to the best of my knowledge, been neglected before. Enormous amounts of time, efforts, money and energy are expended by the more "normal" – because of the "less normal" and the "eccentric". These operators are likely to regard the maintaining of their internal emotional balance as paramount, far over-riding economic considerations. They will sacrifice economic advantages and benefits and adversely affect their utility outcome in the name of principles, to quell psychological tensions and pressures, as part of obsessive-compulsive rituals, to maintain a false grandiose image, to go on living in a land of fantasy, to resolve a psychodynamic conflict and, generally, to cope with personal problems whic h have nothing to do with the idealized rational economic player of the theories. If quantified, the amounts of resources wasted in these coping manoeuvres is, probably, mind numbing. Many deals clinched are revoked, many businesses started end, many detrimental policy decisions adopted and many potentially beneficial situations avoided because of these personal upheavals.

Speculators and middlemen are yet another species of parasites. In a theoretically totally efficient marketplace – there would have been no niche for them. They both thrive on information failures. The first kind engages in arbitrage (differences in pricing in two markets of an identical good – the result of inefficient dissemination of information) and in gambling. These are important and blessed functions in an imperfect world because they make it more perfect. The speculative activity equates prices and, therefore, sends the right signals to market operators as to how and where to most efficiently allocate their resources. But this is the passive speculator. The "active" speculator is really a market rigger. He corners the market by the dubious virtue of his reputation and size. He influences the market (even creates it) rather than merely exploit its imperfections. Soros and Buffet have such an influence though their effect is likely to be considered benefic ial by unbiased observers. Middlemen are a different story because most of them belong to the active subcategory. This means that they, on purpose, generate market inconsistencies, inefficiencies and problems – only to solve them later at a cost extracted and paid to them, the perpetrators of the problem. Leaving ethical questions aside, this is a highly wasteful process. Middlemen use privileged information and access – whereas speculators use information of a more public nature. Speculators normally work within closely monitored, full disclosure, transparent markets. Middlemen thrive of disinformation, misinformation and lack of information. Middlemen monopolize their information – speculators share it, willingly or not. The more information becomes available to more users – the greater the deterioration in the resources consumed by brokers of information. The same process will likely apply to middlemen of goods and services. We are likely to witness th e death of the car dealer, the classical retail outlet, the music records shop. For that matter, inventions like the internet is likely to short-circuit the whole distribution process in a matter of a few years.

The last type of market impeders is well known and is the only one to have been tackled – with varying degrees of success by governments and by legislators worldwide. These are the trade restricting arrangements: monopolies, cartels, trusts and other illegal organizations. Rivers of inks were spilled over forests of paper to explain the pernicious effects of these anti-competitive practices (see: "Competition Laws"). The short and the long of it is that competition enhances and increases efficiency and that, therefore, anything that restricts competition, weakens and lessens efficiency.

What could anyone do about these inefficiencies? The world goes in circles of increasing and decreasing free marketry. The globe was a more open, competitive and, in certain respects, efficient place at the beginning of the 20th century than it is now. Capital flowed more freely and so did labour. Foreign Direct Investment was bigger. The more efficient, "friction free" the dissemination of information (the ultimate resource) – the less waste and the smaller the lebensraum for parasites. The more adherence to market, price driven, open auction based, meritocratic mechanisms – the less middlemen, speculators, bribers, monopolies, cartels and trusts. The less political involvement in the workings of the market and, in general, in what consenting adults conspire to do that is not harmful to others – the more efficient and flowing the economic ambience is likely to become.

This picture of "laissez faire, laissez aller" should be complimented by even stricter legislation coupled with effective and draconian law enforcement agents and measures. The illegal and the illegitimate should be stamped out, cruelly. Freedom to all – is also freedom from being conned or hassled. Only when the righteous freely prosper and the less righteous excessively suffer – only then will we have entered the efficient kingdom of the free market.

This still does not deal with the "not serious" and the "personality disordered". What about the inefficient havoc that they wreak? This, after all, is part of what is known, in legal parlance as: "force majeure".

There is a raging debate between the "rational expectations" theory and the "prospect theory". The former - the cornerstone of rational economics - assumes that economic (human) players are rational and out to maximize their utility (see: "The Happiness of Others", "The Egotistic Friend" and "The Distributive Justice of the Market"). Even ignoring the fuzzy logic behind the ill-defined philosophical term "utility" - rational economics has very little to do with real human being and a lot to do with sterile (though mildly useful) abstractions. Prospect theory builds on behavioural research in modern psychology which demonstrates that people are more loss averse than gain seekers (utility maximizers). Other economists have succeeded to demonstrate irrational behaviours of economic actors (heuristics, dissonances, biases, magical thinking and so on).

The apparent chasm between the rational theories (efficient markets, hidden hands and so on) and behavioural economics is the result of two philosophical fallacies which, in turn, are based on the misapplication and misinterpretation of philosophical terms.

The first fallacy is to assume that all forms of utility are reducible to one another or to money terms. Thus, the values attached to all utilities are expressed in monetary terms. This is wrong. Some people prefer leisure, or freedom, or predictability to expected money. This is the very essence of risk aversion: a trade off between the utility of predictability (absence or minimization of risk) and the expected utility of money. In other words, people have many utility functions running simultaneously - or, at best, one utility function with many variables and coefficients. This is why taxi drivers in New York cease working in a busy day, having reached a pre-determined income target: the utility function of their money equals the utility function of their leisure.

How can these coefficients (and the values of these variables) be determined? Only by engaging in extensive empirical research. There is no way for any theory or "explanation" to predict these values. We have yet to reach the stage of being able to quantify, measure and numerically predict human behaviour and personality (=the set of adaptive traits and their interactions with changing circumstances). That economics is a branch of psychology is becoming more evident by the day. It would do well to lose its mathematical pretensions and adopt the statistical methods of its humbler relative.

The second fallacy is the assumption underlying both rational and behavioural economics that human nature is an "object" to be analysed and "studied", that it is static and unchanged. But, of course, humans change inexorably. This is the only fixed feature of being human: change. Some changes are unpredictable, even in deterministic principle. Other changes are well documented. An example of the latter class of changes in the learning curve. Humans learn and the more they learn the more they alter their behaviour. So, to obtain any meaningful data, one has to observe behaviour in time, to obtain a sequence of reactions and actions. To isolate, observe and manipulate environmental variables and study human interactions. No snapshot can approximate a video sequence where humans are concerned.

If you're using AdWords or AdSense you must have heard about an emerging practice in the underworld of computing called "click fraud". But what exactly is click fraud and how is it accomplished?

Well AdSense uses a payment mechanism that awards a certain amount of money to a publisher (someone who holds an AdSense banner on their page) every time a person clicks on the said banner. So click fraud is the attempt to have people clicking the ads just so that they can earn a greater income.

There are people setting up sites for the sole purpose of fraudulently generating revenue through Google's AdSense program. These users achieve an incredible number of clicks through many methods, some complex and sophisticated and some rudimentary and simple.

One of the most complex is through the use of so called "hitbots". These are automated programs who emulate clicking the links in AdSense banners (there are some that actually click the banners as well).

Google's AdSense protection scheme is by no means perfect and nearly anyone can find the details of surmounting the protection mechanism, ironically just by doing a Google search.

Another, more rudimentary method is to hire a lot of people in a poor country to click the links on your site. This means these people will actually sit all day and just click links so you can earn a fortune. They come from very poor countries like India, and they're prepared to do so for just $0.50 an hour.

Of course, there's a problem with this mechanism. Once Google receives a large number of clicks from a single address, the address and the site that had the AdSense banner will be banned, and the illicit behavior might even get the fraudster sued.

To prevent this from happening, many people use a large number of proxy servers for the purpose of clicking. These are basically trojans, located on computers throughout the world (though mostly in the US). What's even more daunting is that these clicks will appear to originate from an actual computer so such scams are really hard to detect.

And don't think this happens only in isolated instances. There is a great deal of illegal activity in this domain.

In fact there's so much that if search engine companies don't increase their security with such programs as AdSense, such criminal behavior could become more become even more damaging.

Google has a very strict policy regarding click fraud, and it has sued those employing such techniques in the past. But while the search engine giant tries its best to minimize the risk of click fraud there's certainly room for a lot of improvement.

It is estimated that more then 20% of the clicks that follow an AdSense link are just done in order to get money from the person paying for the ad. Some people believe the number of fraudulent clicks to be even twice as large.

There are a great deal more schemes involving click fraud, such as groups of AdSense publishers clicking each other's links (which is referred to as "clicking rings", or spamming people so that they click such links.

Despite Google still holding click fraud on a leash, the phenomenon is certainly raising concerns for the advertisers on AdWords, but despite this advertising with Google's AdSense still remains more profitable for the advertiser, as opposed to traditional untargeted advertising schemes.

There are some means of protection against such schemes and all advertisers should be savvy enough to employ them. Many advertisers choose to avoid the content network all together for fear of click fraud.

Many web site owners are getting their Google Adsense account terminated when they have done nothing wrong to deserve the punishment. Considering the money that they are getting from Adsense, they would certainly want to get back into it.

Considering the money to be made with Adsense, it is no wonder that they would want to get back into it.

It is that same consideration why the Google Adsense click fraud is thought of and why many people are getting into it.

Click fraud is the act of clicking on ads for the purpose of costing the advertiser money. It is simply the same as paying out cash for false leads. Many people website owners are aware of this fraud and are sharing the same sentiment that this is the one big problem that Adsense is facing.

How do you prevent being involved in this fraud?

Majority of web hosts are offering access logs. Once this is offered to you, it is necessary that you hand it over to Google as well. This allows them to look for any suspicious activity on your site. Problems like this are very serious and giving it to them is saying that you would want to help them in any way you can in solving the problem.

It can also help if you have a click monitoring software. If you do not have one yet, you should try and get one. There is absolutely no major factor preventing you from having one because most of this software is free.

Study your server logs and watch for any activity that seems suspicious. Report anything that you may find odd, may it big or small thing.

You may want to consider disabling ads for your own IP address and local geographic area. This will certainly prevent accidents and will not make Google mistake another user as you. You can do through a htaccess file. This will avoid Google mistaking as clicking on your own ads and be kicked out because of it.

Keep your Adsense off on pop ups and pop unders. Your ads should not be displayed on content sites that promote illegal activity or tampering of the legal rights of other people or business. Included in this are the content that is considered adult and gambling ones. If you think that you may be breaking this rule, immediately remove your content or Adsense from the web page.

Be truthful and confess up to Google about times when you might have clicked on your own as, whether accidentally or intentionally. Or the times when you have done something that is against the Terms of Service that they are implementing. Be honest about anything that you may have done that is wrong. Confessing is way better than Google learning about it eventually. It would mean eventual termination and no getting back what you have worked so hard for.

Do not tell your family or friends about Adsense on your website. Chances are they may start clicking on them to help you make money without you knowing it. They may be doing more harm to you than help by trying it in the first place.

If ever someone you know chanced upon your Adsense, make sure they understand that they cannot click on your ads under any circumstances. It would be wise to brief them on important things about Adsense and what not to do with them.

            Many wonder why so many criminal offenders are walking away with what seems to be a slap on the wrist.  Community based corrections is the answer.  But we must remember that initial perceptions can be misleading.  What seems to be a slap on the wrist may in fact be a way to protect the safety of the community while attempting to teach criminals how to live in society.  Community based corrections helps offenders to learn how to obey the rules and regulations set forth by society and to be upstanding members of the community.  In order to accomplish this, a person must understand what sanctions fall under community based corrections, what those sanctions actually mean, and know the goals that community based corrections are trying to reach.
            There are many community based sanctions: restitution, fines, probation, intensive probation, parole, day reporting, deferred sentences, diversionary programs, split sentencing, work release, community service, house arrest, electronic monitory, and boot camp.  These are just a few of the sanctions that fall under the category of community based corrections.  Restitution is a monetary payment ordered by the court to be paid by the offender directly to the victim or to a public fund set aside for victims of crimes (Bartollas, 2002).  Fines are similar to restitution, they are monetary payments ordered by the court to be paid by the offender.  Unlike restitution, fines are payments that go to the court.
             Probation is probably the most popular and widely used form of community based sanctions (Alarid & del Carmen, 2010).  Probation is defined as punishment that allows an offender to stay in the community after his/her conviction with the stipulation that they remain under the supervision of a probation officer and abide by the conditions of probation set forth by the court (Bartollas, 2002).  Intensive probation is like regular probation with stricter supervision of the offenders (Bartollas, 2002), such as more frequent meetings, home visits, job training, and more drug tests. Parole is much like probation as far as community supervision goes but parole is a continuation of a sentence, given at the discretion of a parole board, which gives conditions of early release to offenders serving indeterminate sentences (Alarid & del Carmen, 2010).  Parolees must report to their parole officers, find and maintain jobs, and find stable places to reside.  Day reporting is when an offender on probation must report daily to a special facility.  The facility offers counseling, social skill training and other activities that aid toward rehabilitation (Bartollas, 2002).
            A deferred sentencing is handed down by a judge.  It is generally given to first time offenders or offenders of nonviolent crimes.  Bartollas (2002) defines it as “a sentence that delays conviction on a guilty plea until the sentenced offender has successfully served his/her probation term.”  Diversionary programs are alternative to imprisonment (Bartollas, 2002).  Split sentencing a when a judge feels that an offender needs to see what it is like to be in jail in an attempt to “scare them straight” followed by a set time of probation within the offenders community (Bartollas, 2002).  Work release is given to some offenders who have jobs within the community that they will be able to keep even after their sentence is complete. Bartollas (2002) defines it as the release of an offender from jail during the day so they can maintain employment.  Some jurisdictions allow the offender to complete their sentences on the weekends while others require them to return to the jail every evening.
            The intermediate sanctions under community based corrections are just extensions of probation.  Community service is sentence that requires an offender to spend a set number of hours working in the community either for a private nonprofit organization or for a government funded agency (Bartollas, 2002).  Bartollas (2002) states that house arrest is a sentence that requires an offender to remain in the confinement of his/her own home for the entire or remainder of the sentence.  Electronic monitoring is court ordered monitoring using electronic equipment that shows that an offender is where he or she is suppose to be, like their home or a community correctional center (Bartollas, 2002).  Boot camp is a more extreme form of probation.  It is a facility that operates in a military style and is used as an alternative to prison.  It is mainly used to cut down on prison overcrowding while meeting the demands of severe punishment by the community (Bartollas, 2002). 
            Community based corrections have the goal of punishing offenders and protecting the public.  Community based corrections aims to address the needs of victims as well as do what it can to reduce recidivism rates (Bartollas, 2002).  This is done through rehabilitation, reintegration into the community, and restoring justice (Alarid & del Carmen, 2010).  Offenders are rehabilitated through drug programs, skill training programs, or life management programs.  They are then placed back into the community.  Some offenders are put straight back into general population while some offenders first live in group residences, such as halfway houses and privately owned houses set up for offender reintegration.  Through this process the goal is to restore justice.  Restorative justice is victim oriented and strives for offenders to take responsibility for their actions and to repair the injustices that they have caused (Alarid & del Carmen, 2010).

Eyewitness Accounts: The Lineup Procedure

Ethical issues have been brought up within in the field of criminal investigation pertaining to wrongful convictions as a result of tainted lineups.  In recent years there have been a number of criminal convictions overturned for numerous reasons; one of which being eyewitness accounts.  With an explanation of ethical responsibility of law enforcement to ensure there are no wrongful convictions based on eyewitness testimony, the process used by law enforcement in the identification of suspects, and prejudicial lineups and photo arrays one will be able to understand what is being done to ensure that false identification does not occur neither accidently or intentionally.
It is the responsibility of law enforcement personal to gather all the eyewitnesses following a crime.  Once the eyewitness has been identified they should be kept from other eyewitnesses so that there is not time for the witnesses to talk to each other.  Allowing the witnesses to discuss the event could cause a witness to doubt what they have seen or to collaborate other witnesses’ details into the details from their own memory.  Once the officers have a chance to interview the witnesses, the one with the best memory of the perpetrator should sit down with a sketch artist and a composite should be made.  Witnesses remember in two forms: recall and recognition.  Recall is a memory of the event that can be made verbally.  Recognition is when a witness can pick a person out of a lineup or photo array of mug shots from the Rogue’s Gallery (Osterburg & Ward, 2007).  Not all witnesses to the identification of the perpetrator should be involved in the sketch or able to view a photo array (Foster, 2005) because it is vital that someone can pick the suspect out of a lineup for positive identification.  A lineup is when a suspect is grouped with others for the purpose of being identified by an eyewitness.  A photo array is a group of photographs from the Rogue’s Gallery compiled together along with a picture of the suspect for identification from an eyewitness.  A photo array can be done in lieu of a lineup, but only if a lineup is not feasible (Osterburg & Ward, 2007).
Once a suspect has been picked up a lineup should be done as soon as absolutely possible.  This is because the less time between the crime and the lineup the better the memory of the eyewitness, if the suspect is not the perpetrator the innocent can get be freed faster, and if the suspect is released on bond prior to the lineup the entire process could be “delayed or frustrated” (Osterburg & Ward, 2007).  Because of the need for speed in conducting a line up a procedure should be put in place to help things along.  The procedure should include a quick way of contacting all eyewitnesses, gathering people other than the suspect, and for contacting a lawyer to be present.
It is the responsibility of law enforcement personal to conduct the lineup.  It is vital that they exercise extreme caution to do so in an attempt to not contaminate the results.  The Supreme Court has ruled that a police lineup should consist of at least three people and the ratio should be two non suspects for every one suspect in the lineup (Osterburg & Ward, 2007).  In gathering participants for the lineup police should be sure to select those that resemble the suspect.  The participants should be of the same approximate height, weight, age, skin tone, body type, and sex.  They should have the same hair color, style, and length.  If the suspect has a mustache or sideburns so should all the participants.  If the eyewitness remembers a distinguishing article of clothing or glasses then all participants including the suspect should wear that item.  If not enough of the distinguishing article can be found then no one should wear anything resembling it (Osterburg & Ward, 2007).
To help ensure that a witness does not make a false identification, the witness should not have any help picking out the perpetrator from the lineup.  Law enforcement need to make sure certain steps are followed to be sure that the lineup is not being biased and that the identification will hold up in court and not result in a conviction being overturned due to the identification of the suspect.  The perpetrator should be permitted to choose what spot he wants to stand in during the lineup and be allowed to switch the spot after every witness that views the lineup.  Only one eyewitness should be permitted to view the lineup at a time and none of the witnesses should be allowed to talk to one another.  To be completely safe no witness should see each other during this process so that no gestures are given that can give away who the person picked during their viewing of the lineup.  The lineup must recorded to ensure that all identifications were done on the eyewitnesses accord and that they were offered no help (Bennett, Hess, & Orthmann, 2007).  Last but not least the 6th Amendment of the U.S. Constitution guarantees the suspect the right of council and this includes during the lineup (United States v. Wade, 388 U.S. 218, 1967). The suspect has the right to waive council during this process but he/she must sign a waiver stating that they are waiving their right to council (Bennett, Hess, & Orthmann, 2007).
The responsibility falls on law enforcement to make sure the proper steps of identification is followed, that the witnesses are not biased upon making the identification, and to ensure the suspect gets a fair chance at the lineup procedure.  Many convictions have been overturned because of faulty lineups and eyewitness identifications, but when law enforcement personal do their jobs to ensure the lineup is not tainted this becomes less of a possibility.
